Our Square Pty. Ltd. (ABN 17 693 163 423), trading as Our Square, Burpengary QLD 4505. Version 3.0. Effective date: [to be set at go-live]. These terms are under final legal review and may be updated before launch.
1. Acceptance
1.1 These Buyer Engagement Terms apply when you use the “build my team” journey or create a buyer account. They apply in addition to the Website Terms of Use and Privacy Policy.
2. Using the marketplace without an account
2.1 You may build a specialist list and contact specialists through the public “build my team” journey without creating an account. Your list and progress are stored in your own browser, not on our servers, until you verify an email address, email yourself the list, or create an account.
2.2 Before your first enquiry is sent, you must verify that you control the email address you provide, by entering a one-time code we email to you. This protects specialists (and the owner of the email address) from impersonation.
2.3 To prevent duplicate enquiries, we keep a permanent record of which specialists a verified email address has contacted through this feature. Repeat sends only go to specialists not previously contacted from that address.
2.4 If you email yourself your list, the email contains a private resume link that restores your list in any browser without an account. The link works for 90 days. Anyone with the link can view and restore the list, so do not forward it.
2.5 Anti-abuse measures (verification codes, bot protection, sending limits) apply to the anonymous journey. Attempting to circumvent them is a breach of the Website Terms of Use.
3. Account creation
3.1 An account is required to keep lists across devices, manage a list per property, and access saved land with document quick-links. Account creation is passwordless: we email you a magic sign-in link. If you built a list before creating the account, it is imported into the account automatically.
3.2 You must be at least 18 years old to create an account. The website is not intended for children.
3.3 You must provide truthful account information and keep it current. Providing false information (including impersonation) may result in account suspension.
4. Buyer lists and contacting specialists
4.1 You may create one or more lists (“teams”), collections of specialists for a project (e.g. a specific block, a renovation). Lists are private to you; specialists are not shown who else is on your list.
4.2 The contact feature sends an individual enquiry email to each selected specialist. Each email contains your name, email address, and (if provided) phone number; has the Reply-To header set to your email so replies come directly to your inbox; and is sent separately to each specialist so no specialist can see who else you contacted.
4.3 A seven-day cooldown (for account holders) and a permanent duplicate-send bar (for the anonymous journey) protect specialists from repeated unsolicited enquiries.
4.4 By using the contact feature you consent to your information being shared with the selected specialists for the purpose of responding to your enquiry.
5. Communications with specialists
5.1 Once you have sent an enquiry, communications between you and the specialist occur outside the platform. Our Square does not sit in the middle of those conversations and does not read, retain, or process the content of external communications after the initial enquiry.
5.2 The specialist receiving your enquiry is an independent Third Party, not an employee, agent, partner, or representative of Our Square. The specialist is solely responsible for any advice or services they provide, and Our Square takes no responsibility for any advice received from a specialist or Third Party.
5.3 Our Square is not a party to any engagement, contract, or transaction that arises between you and a specialist.
6. What Our Square does not do
6.1 Our Square:
(a) Does not verify the outcome of any engagement between you and a specialist;
(b) Does not provide legal, financial, tax, or real-estate advice;
(c) Does not conduct due diligence on your behalf;
(d) Does not, by any general information provided in response to your enquiry or by the order in which specialists appear, recommend or suggest that one specialist should be considered better than another;
(e) Does not use artificial intelligence to select or match specialists, journeys are fixed, administrator-configured category templates;
(f) Does not guarantee specialist response times, though specialists commit to responding within two business days.
6.2 You should obtain independent legal advice before making any decision in respect of cooling-off periods or any other term of a proposed contract for the purchase of land.
7. Liability
7.1 To the maximum extent permitted by law, and subject to clauses 7.2 and 7.3, Our Square is not liable for the conduct or performance of any specialist, the accuracy of any listing, or any loss arising from your engagement with a specialist or your reliance on marketplace information.
7.2 Nothing in these Terms excludes any consumer guarantee under the Australian Consumer Law, or liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
7.3 You acknowledge that in using the marketplace you have not relied on any statement, representation, or assurance made by Our Square or any Third Party other than those expressly set out in these Terms and the documents they incorporate.
8. Retention and deletion of your account
8.1 If you create an account and do not activate it within 30 days, we will delete it. A warning email is sent the day before deletion.
8.2 If your account is inactive for 24 months (no login), we will delete it. A warning email is sent 30 days before deletion.
8.3 You may delete your account at any time via portal, Account, Delete my account. Your account, saved lists, and saved land are deleted immediately; enquiries you sent are de-identified but retained per our retention schedule; feedback becomes anonymous. Deletion is not reversible.
9. Disputes
9.1 These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute will be heard exclusively in the courts of Queensland, Australia, unless otherwise required by law. Each party waives any objection to proceedings being brought in those courts on the basis of inconvenience or alternative forum.
