1. Application and verification
1.1 To list land on Our Square you must complete the application form and be approved by Our Square. Approval typically takes up to seven business days pending title verification.
1.2 You warrant that you are the registered owner of the land, or that you hold written authority from the registered owner to list the land for sale.
1.3 Our Square verifies title and ownership against the Queensland Titles Registry before approving your listing. Beyond that verification, all listing information is supplied by you and liability for its accuracy rests with you.
2. Listing fields and edit control
2.1 You may edit your listing at any time via the seller portal. Certain fields (“amber fields”, property address, title reference, price changes exceeding 10%) require Our Square review before publication.
2.2 You must ensure your listing accurately reflects the property, including any encumbrances, covenants, easements, and restrictions.
2.3 Photos must depict the actual property. Renders or photographs of a different property must be clearly labelled.
2.4 Our Square lists the property on your behalf but does not act in place of, or as a representative of, you as Seller, and is not a real estate agent for the transaction.
3. Attachments
3.1 You may upload attachments (title certificates, site plans, contour surveys, covenant documents, DA documents) and control the visibility of each: “Public”, “Enquirers only” (visible to buyers who have enquired), or “Admin only”.
3.2 You warrant that any attachment you upload is one you are entitled to distribute and that it does not contain third-party personal information without consent.
4. Fees
4.1 Fees for listing land are as notified to you at the time of listing. Our Square does not charge a commission on the sale of the land.
5. Enquiries
5.1 Enquiries from prospective buyers are delivered to your account email with the buyer’s email set as Reply-To. You must respond within a reasonable time; consistent failure to respond may result in suspension.
6. Sale and archival
6.1 When the land is sold, you must mark it as sold in your seller portal. A 30-day grace period follows during which the listing is hidden, enquiries stop, and you may un-sell if the sale falls through.
6.2 After 30 days: a complete archive of your listing (data, photos, PDFs, enquiries, analytics) is emailed to you as a ZIP file; the live listing is retired; and a permanent row is added to the public sold register showing sold date and price as market data. The archive is retained for 24 months for restoration if a sale is reversed.
7. Warranties, indemnity, and general
7.1 You warrant that you have authority to list and sell the land; your listing is accurate and not misleading in any material respect; the land is not subject to any undisclosed encumbrance; and all uploaded attachments are your own or licensed for use.
7.2 You indemnify Our Square against loss arising from a claim by a third party, to the extent that loss is caused by your breach of this Agreement or your negligence, including any claim arising from inaccurate listing information you supplied.
7.3 Our Square’s liability under this Agreement is limited as set out in the Website Terms of Use. Clauses 8.1 to 8.4 of the Specialist Listing Agreement (entire agreement, severance, jurisdiction, amendment) apply to this Agreement as if set out in full, with references to the Specialist read as references to the Seller.
