2. Listing contents and control
2.1 You may edit your listing at any time via the specialist portal. Certain fields (“amber fields”, business legal name, licence number, service region expansion) require Our Square review before publication.
2.2 You warrant that your listing content is accurate, not misleading, and does not infringe any third-party rights.
2.3 You must not use your listing to promote unrelated products or services, or to make representations that would breach the Australian Consumer Law.
2.4 You may pause your own listing, reactivate it, or request deletion (with a 30-day cancellation window) at any time via the specialist portal.
2.5 Listing inclusion, position, order, and presentation on the marketplace are determined by Our Square and are subject to change at Our Square’s sole discretion. The position of a Specialist does not suggest to a buyer or user any preference for that Specialist, and must not be construed as an endorsement or recommendation.
3. Enquiries, response, and breach notices
3.1 When a buyer contacts you via the marketplace, you receive an email at your registered address with the buyer’s email set as the Reply-To header so you can reply directly.
3.2 You commit to acknowledging buyer enquiries received via Our Square within two business days. This commitment is a material term of listing.
3.3 If Our Square reasonably considers you to be in breach of this Agreement, it may issue a written notice identifying the breach (a “Breach Notice”). Upon receipt of a Breach Notice your listing may be suspended in accordance with clause 5 pending investigation and any remedy.
4. Fees
4.1 As at the effective date, listing on Our Square is free of charge. Our Square receives no commission, referral fee, or transaction-linked payment in respect of any engagement between you and a buyer.
4.2 Our Square may introduce listing or advertising fees in future on not less than 30 days’ written notice. If you do not wish to pay an introduced fee, you may remove your listing before the fee takes effect without penalty.
5. Suspension and removal
5.1 Subject to applicable law, including anti-discrimination legislation, Our Square may suspend or remove your listing:
(a) For breach of this Agreement (including following a Breach Notice);
(b) If your professional credentials lapse or are cancelled;
(c) For consistent complaints from buyers, following the review process in clause 6;
(d) On 30 days’ written notice for any other reason.
5.2 When your listing is suspended or removed: you are hidden from search and all buyer team views; existing team members see you marked as “no longer available”; the contact feature will not include you; and historical enquiries and analytics remain in your account until 24 months post-removal.
6. Reviews, ratings, and complaints about you
6.1 Ratings, reviews, and feedback about a Specialist are statements of opinion formed by users; they do not represent the views of Our Square.
6.2 Complaints or adverse feedback about a Specialist are handled under Our Square’s Review & Content Moderation Policy: the complaint is acknowledged within 2 business days; investigated within 14 days; and you are given a reasonable opportunity to respond before any adverse action (including suspension or publication of a moderated review) is taken, save where urgent action is required to protect users or comply with law.
6.3 You must not manipulate, procure, or fabricate reviews or engagement metrics.
7. Data, warranties, and liability
7.1 You consent to Our Square displaying your business name, credential numbers, contact details, and other listing content to marketplace users. You will handle any personal information about buyers received through Our Square in accordance with the Privacy Act 1988 (Cth) and any professional obligations applying to you.
7.2 You indemnify Our Square against loss arising from a claim by a third party, to the extent that loss is caused by your breach of this Agreement or your negligence.
7.3 You warrant that you will maintain any professional indemnity insurance required for your category during the term, and will provide services with due care and skill and in accordance with all applicable law.
7.4 Subject to the Australian Consumer Law and any non-excludable liability, Our Square’s liability under this Agreement is limited to the fees paid by you in the 12 months preceding the claim, or AUD$100 if no fees have been paid.
8. General
8.1 This Agreement is the entire agreement between Our Square and the Specialist in relation to its subject matter. No other term is included except where required by legislation of the Commonwealth or a State or Territory. All implied terms except those implied by statute that cannot be excluded are expressly excluded. The parties’ obligations do not merge on completion of any transaction.
8.2 If any provision of this Agreement is found to be invalid or unenforceable, that provision is severed and does not affect the validity, enforceability, or interpretation of the remaining provisions, which continue in full force. If the severed provision is valid and enforceable in any other State or Territory, it remains fully effective and forms part of this Agreement in those jurisdictions.
8.3 This Agreement is governed by the laws of Queensland and the Commonwealth of Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland, the courts of the Commonwealth of Australia, and any court that may hear appeals from those courts, and waive any objection to those courts on the basis of inconvenience or alternative forum.
8.4 Our Square may amend this Agreement on not less than 14 days’ written notice to your registered email address, accompanied by a notice in the specialist portal. Material amendments (including any introduction of, or increase to, fees) require your express acceptance in the portal before they bind you; if you do not accept, you may remove your listing without penalty before the amendment takes effect. Continued listing after the notice period constitutes acceptance of non-material amendments.
